1. Definitions?The following definitions apply to these Terms: "Application" means any web-based or mobile software used to access our services. "User" refers to any individual accessing or using our Services. "Vendor" refers to any external service provider engaged through our platform. "Listing" means any published availability of services. "Services" refers to all offerings described in clause 2. "Site" means our website at?https://westministertenants.com. Additional terms are as defined contextually throughout this document.
2. Services?Westminister Tenants Management offers a platform and services covering property sales, rentals, parking management, tenant management, and coordination with external vendors in categories including but not limited to security, cleaning, utilities, telecoms, interior design, brokerage, delivery, relocation, access control, property and facility maintenance, and mobility solutions.
3. Scope and Limitations?These Terms form a legally binding agreement governing all interactions with our Services. We act as a facilitator and are not liable for third-party vendor performance unless explicitly stated. Listings and third-party offerings are provided in good faith but without warranty. You assume full responsibility for using third-party services or spaces booked through our platform.
4. Availability of Site, Application and Services?We aim to provide uninterrupted access to our Site and Application but reserve the right to modify, suspend, or terminate access without notice. Availability may be affected by maintenance or third-party systems beyond our control.
5. User Account?Users must be 18 years or older and provide accurate, current information. You are solely responsible for safeguarding your account and authorizing its use. We may suspend or terminate accounts found to be in violation of these Terms. Creation of multiple accounts or fraudulent activity is grounds for account termination.
6. Listings?Listings detail service availability and may include pricing, specifications, timing, and additional materials such as promotional content. We do not guarantee listing accuracy or availability. Ranking and visibility of listings depend on algorithmic and operational criteria.
7. Bookings?Bookings become binding upon confirmation and form a new contract between the User and Westminister Tenants Management. All bookings are subject to availability. Cancellations must comply with the applicable cancellation and refund policy, if any.
8. Access to Parking Bays?Access methods include license plate recognition, QR code, or confirmation with on-site personnel. Access is restricted to the booking period. Failure to follow designated entry and exit procedures may incur penalties.
9. Parking and Conduct Rules?You may only use designated parking bays for their intended purpose. Oversized vehicles, trailers, or unauthorized activities such as storage or washing are prohibited. Users must follow all posted and communicated rules and are responsible for third parties using their booking.
10. Detention, Immobilization, and Removal of Vehicles parked improperly, or outside permitted hours may be towed or immobilized at the owner's cost. Vehicles that pose safety hazards or block access may also be removed without prior notice.
11. Fees and Charges?All pricing is listed in local currencies and includes VAT unless stated otherwise. Fees vary by service and booking duration. We reserve the right to update pricing at any time. Any increase will apply to future bookings only.
12. Payment?Payment can be made using EFT, credit/debit cards, or other approved gateways. By providing payment details, you authorize us to charge your account for applicable fees. Non-payment may result in service suspension or legal action.
13. License for Application?You are granted a limited, non-exclusive, non-transferable license to use our Application for personal or commercial use. Unauthorized distribution, modification, or reverse engineering is strictly prohibited.
14. Use of the Application, Site, and Services?You must not misuse the Services. Prohibited activities include unauthorized access, illegal or fraudulent conduct, spamming, distribution of malware, and interference with service operations. We reserve the right to restrict access for any breach.
15. Intellectual Property?All content on the Site and Application, including text, logos, images, and software, is our intellectual property or that of our licensors and vendors. No rights are granted beyond those expressly provided in these Terms.
16. Disclaimers, Liability & Indemnity?The Services are provided “as is.” We disclaim all warranties not expressly stated in these Terms. To the extent permitted by law, we are not liable for direct or indirect loss resulting from use of our Services. You agree to indemnify us for any claims arising from your breach of these Terms or misuse of the Services.
17. Changes to Terms?We may update these Terms from time to time. Changes take effect upon publication. Continued use of the Services after changes are posted constitutes acceptance.
18. Currency, Taxes, and Governing Law?All amounts are in local currencies. These Terms are governed by the laws of the Republic of Kenya. Users are responsible for compliance with any tax obligations.
19. Vendor-Related Services?We collaborate with a range of third-party service providers. While we facilitate introductions or access, each vendor operates independently. We do not warrant vendor services and are not liable for vendor conduct, except where a separate written agreement applies.
